What does it protect?

What benefits does registration/filing include?

Copyright registration enhances applicant's rights by providing legal evidence and public notice of ownership, and by allowing the copyright holder to bring suit in federal court in cases of infringement.

Trademark registration enhances applicant's rights by providing legal evidence and public notice of ownership. It provides exclusive rights to the mark and allows the holder to bring lawsuits against infringers.

A patent provides owner exclusive right to prevent others from making, using, selling, or importing the patented invention.

A design provides owner exclusive right to prevent others from making, using, selling, or importing the protected design.

How long does it last?

A copyright protection lasts the author's lifetime, plus an additional 70 years.

A trademark registration can have an unlimited term, but must be renewed every 10 years.

A patent protects an invention up to 20 years, but must be renewed every year after grant.

A design patent protects a design for 25 years, but must be renewed every 5 year.

Frequently Asked Questions

The Trademark registration is valid forever one its Registered. However, renewal is required for every ten (10) years to maintain the Registration. If renewal is missed, the Trademark will be Abandoned/Lapsed. Hence as your Trademark Agent, we will record and remind the important dates for our clients.

TM is used to indicate a user has intention or in process of registering the trademark. However, the ®, is reserved or could be only used for marks that has been registered with the IP office. Unauthorized us liable for fine and imprisonment in Malaysia. 

It is highly advisable to use the services of a competent & Licensed Trademark Agent or Attorney for your  IP/Trademark matters.

As Non-qualified & licensed agents and not-lawyers may give you inaccurate information and legal advice about your trademark rights and the registration process in the specified country. This could:

  • Risk the legal validity of your application or registration
  • Prolong the time it takes for your application to be examined & delayed the process.
  • Cause your application to be rejected or abandoned or your registration will cancelled.
  • Missed the due date such as Renewal, Refusal and Risk the application to abandoned.

Certain trademark which consists of immoral, deceptive, or scandalous matter; or matter which could represent or falsely suggest a connection with persons, living or dead, institutions, beliefs, or national symbols, or bring them into contempt, or disrepute; or a geographical indication.

Further, trademarks which other traders would or may want to use to describe their goods or services are not registrarable as well. For example, the mark should not be descriptive or direct reference to the goods,  for example “Best” and “Top Quality”, even if its not found during Trademark Search.

It is important to file your trademark if you are selling (or promoting) goods or services in a “first to file” jurisdiction, otherwise someone else could file a trademark for your brand name, and then stop you from trading your goods or services under that brand even if you have been using that brand before them. This has happened not in China, also in Malaysia, Indonesia, Singapore as well for few famous brands. 

Trademark protection is territorial in nature. If you registered the mark in Malaysia, your mark is only protected in Malaysia. Therefore, our team will assist you file the Trademark protection in required country and provide advice in accordance to the specific countries regulation or law.

In order Trademark to registered, it requires to fulfills at least one of the following requirements:
(1) Name of company or individual
(2) Signature mark
(3) Invented word
(4) Not descriptive of the your product/service, not a geographical name and not a surname.

A trademark is a phrase, word, symbol, or design that differentiates one company’s goods from the goods of other companies. The trademark opposition process during publication after Registrar approval,  opposition period of two (2) months is given for the filing of any opposition (from third-party). After opposition period or overcoming the opposition, the mark will directly to Registered. 

When you file your trademark application, it required to select the class of goods or services that your trademark will protect, and we will assist to identify the goods or services you provide. The trademark application will only cover for the goods, services and class that you name in your application. Classification.
